TERMS & CONDITIONS OF THE LOGISTEAM ONLINE STORE 

§1. Seller Details

2. These Terms & Conditions define the rules for purchasing goods via the online store operated by ENDIMAC P.S.A.

3. The Store sells products within Poland and to other countries in the European Union.

§2. Prices and Orders

1. All prices displayed in the Store include VAT (gross prices).

2. Orders may be placed through the Store website.

3. A sales contract is concluded when the Seller confirms the order by email.

4. The Customer receives an electronic confirmation of order acceptance.

§3. Delivery and Payments

1. Delivery is carried out via courier services or parcel locker services.

2. Deliveries are available within Poland and the European Union.

3. Available payment methods:

   • bank transfer,

   • online payment,

   • cash-on-delivery (where available).

4. Each order is issued with a receipt or VAT invoice.

§4. Transfer of Risk

1. The risk of accidental loss or damage transfers to the Customer upon delivery.

2. In case of visible transport damage, the Customer is advised to prepare a damage report with the courier.
   The absence of a report does not limit the Customer’s statutory consumer rights.

§5. Right of Withdrawal (Consumers)

1. A consumer has the right to withdraw from a distance sales contract within 14 days without giving any reason.

2. The withdrawal period begins on the day the Customer receives the goods.

3. To exercise this right, the Customer must notify the Seller by email or in writing.

4. Returned goods should be sent back in an unchanged condition beyond normal handling.

5. Refunds will be made within 14 days from the day the returned goods are received.

§6. Loss of Withdrawal Right – ENSolarX Devices

1. ENSolarX devices require registration and activation, which results in:

   • assigning the device to a specific user account,

   • activation of digital features and licence services,

   • provision of digital services.

2. In accordance with Article 16(m) of Directive 2011/83/EU and Article 38(13) of the Polish Consumer Rights Act, once the ENSolarX device has been activated and digital services begun, the consumer loses the right to withdraw from the purchase contract.

3. The consumer will be notified of this before activation and must provide explicit consent.

4. Devices that have not been registered or activated may be returned under the standard 14-day withdrawal rules.

§7. Warranty and Statutory Liability

1. All products are covered by a 2-year statutory warranty (legal guarantee).

2. Complaints may be submitted by email or in writing to the Seller’s address.

3. The Seller will respond to complaints within 14 days.

4. If the complaint is accepted, shipping costs will be refunded.

§8. Commercial Warranty (if applicable)

1. Some products may be covered by a manufacturer’s commercial warranty.

2. The terms of such warranty are set out in the warranty documentation supplied with the product.

§9. Personal Data (GDPR)

1. The Controller of personal data is ENDIMAC P.S.A.

2. Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR).

3. Customers have the right to access, correct and delete their data, and to lodge objections.

§10. Final Provisions

1. In matters not regulated herein, Polish law and EU consumer protection law shall apply.

2. The Customer residing in the EU shall not be deprived of protection provided under the mandatory consumer laws of their country of residence.

3. These Terms & Conditions come into force upon publication on the website.
